Terms and Conditions for TJW Tree Services LTD

Definitions
1. Contractor: Refers to TJW Tree Services LTD, including all employees directly or indirectly associated with the company.
2. Client: The person or entity commissioning the services and accepting the provided quotation.
3. Quotation: A detailed written document outlining the services, costs, site address, and client information.
4. Contract: The agreement formed between the client and the contractor based on the accepted quotation.
5. Services: Arboricultural practices that conform to British Standard 3998.

Quotations
1. Quotations are valid for a period of 30 days from the date of issue.
2. VAT will be included at the prevailing rate and will be itemised on all quotations and invoices.
3. Quotations are issued without any obligation on the client’s part.

Agreement Formation
1. Acceptance of a quotation, whether verbal or written, constitutes a binding contract between the client and the contractor for the specified services.
2. The contractor will perform all services in accordance with British Standard 3998 and will strive to maintain clean and tidy work sites, although some unavoidable damage may occur due to the nature of the work.
3. By accepting a quotation, the client agrees to these terms and conditions and thereby commissions the specified services.

Cancellations and Changes
1. Clients must provide at least 72 hours' notice if they need to cancel, postpone, or alter the scope of services. Failure to do so will result in a charge of 50% of the total service value.
2. If the client cancels the contract after the commencement of services, a charge of 75% of the remaining service value will apply.
3. The contractor’s obligations conclude once the client has confirmed satisfaction with the completed services.
4. Should unforeseen circumstances prevent the completion of services, the client agrees to reschedule or cancel the contract.
5. The contractor reserves the right to cancel or reschedule services in hazardous weather conditions.
6. If a quotation is based on client-provided photos and the photos do not accurately represent the tree(s), the contractor reserves the right to void the agreement.

Liability and Responsibilities
1. The client is responsible for notifying neighbours about tree services that extend beyond their property boundaries and is liable for any related claims.
2. The contractor is not liable for damage to underground utilities unless discussed and noted during the quotation process.
3. The contractor accepts liability for property damage caused by negligence or substandard practices.
4. The contractor will obtain all necessary council permissions. If the client cancels the contract after a planning application has been submitted, a charge of £40+VAT will apply.
5. The client is responsible for obtaining any necessary parking permits for controlled zones. The client will bear the cost of any fines if a permit is not provided and no alternative parking is available.
6. The contractor is not liable for property damage resulting from adverse weather conditions during the work.
7. The client must inform the contractor of any significant site changes since the time of the quotation. The contractor reserves the right to amend or cancel the contract due to such changes.
8. The contractor may subcontract part or all of the services but remains bound by these terms and conditions.
9. The client must provide any permissions required for work on protected trees before services commence.
10. The client must ensure tenant access for the contractor. If access is not provided as agreed, the client may incur a charge of 50% of the service value.

Payment Terms
1. Payment in full is due 14 days from the invoice date. Late payments may incur a charge of 10% per week.
2. Payments can be made by bank transfer or cheque.

Stump Grinding Specifics
1. The contractor is not liable for damage to underground utilities unless previously discussed and noted during the quotation process.
2. Stumps will be ground to a depth of 300mm below the adjacent soil level. This includes buttress roots but not lateral roots extending from the stump.
3. Stump grinding debris will be left on-site, arranged in a clean and orderly manner.
